These Terms govern your use of the Becoming Catholic mobile app, provided by Tagaste LLC, a California limited liability company. By downloading, installing, or using the app, you agree to these Terms. If you do not agree, do not use the app.
These Terms cover the Becoming Catholic app only. Our services for parishes and organizations are governed by the Tagaste Labs Terms of Service.
1. License
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the app for your own non-commercial use. All rights not expressly granted are reserved. You may not copy, modify, distribute, sell, lease, reverse engineer, or attempt to extract the source code of the app or its content, except where such restriction is prohibited by law. The app and its content are owned by us or our licensors and protected by intellectual property laws.
2. Accounts
The app does not currently require an account. Any data associated with your use of the app is associated with your device. We may introduce accounts or other features and may modify these Terms accordingly.
3. Acceptable Use
You agree not to misuse the app, including by interfering with its operation or security, attempting unauthorized access, submitting unlawful, harassing, hateful, or abusive content in any feature that accepts it, impersonating others, or using the app in violation of applicable law. We may remove content and suspend or terminate access at our discretion.
4. Content and Features
The app provides devotional, educational, and reference content for personal use and is not a substitute for pastoral, spiritual, medical, or professional advice. Content you submit to us, such as a question or message, may be reviewed by us to respond to it. We do not endorse and are not responsible for third-party content referenced or linked within the app.
5. Modification, Suspension, and Termination
We may modify, suspend, or discontinue the app or any part of it, including any feature, at any time and without liability to you. We may terminate or restrict your access at any time, including for violation of these Terms. Sections 1, 3, 4, 6, 7, 8, and 9 survive termination.
6. Disclaimers, Liability, and Indemnity
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE APP WILL NOT EXCEED TWENTY FIVE DOLLARS ($25). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you, and nothing here limits liability that cannot be limited under applicable law.
You agree to indemnify and hold harmless Tagaste LLC and its members and agents from claims arising out of your use or misuse of the app, your content, or your violation of these Terms or applicable law.
7. Disputes and Class-Action Waiver
Please read this section carefully. It limits the ways you can seek relief.
7.1 Informal resolution. Before initiating formal proceedings, email [email protected] describing the dispute. The parties will attempt in good faith to resolve it within 30 days.
7.2 Class-action waiver. To the fullest extent permitted by law, claims may be brought only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, private attorney general, or representative proceeding. You and Tagaste LLC each waive any right to a trial by jury. If this waiver is held unenforceable as to a particular claim, that claim shall be severed and the remainder of this section shall remain in effect as to all other claims.
7.3 Small claims and agencies. Either party may bring a qualifying individual claim in small-claims court. Nothing here prevents you from reporting a concern to a government agency.
7.4 Time limit. Any claim must be brought within one year after it arises, or it is permanently barred, to the extent permitted by law.
8. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Subject to Section 7.3, any dispute shall be brought exclusively in the state or federal courts located in Sacramento County, California, and you consent to personal jurisdiction there.
9. General
These Terms and the Privacy Policy are the entire agreement between you and us regarding the app. If any provision is unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. We may revise these Terms; when we do, we will revise the effective date above, and continued use after changes take effect constitutes acceptance.
The app is distributed through the Apple App Store and Google Play. Apple and Google are not parties to these Terms and have no responsibility for the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
